Pathway 1 employment rules

Common reasons Pathway 1 applications are declined, and what counts as acceptable employment.

Acceptable premises

You must work from an established, dedicated commercial premises in regional NSW. Not accepted: your home, someone else's home (including your employer's), or co-working and shared offices.

Acceptable employment

Genuine full-time, part-time or casual work for an independent, unrelated employer. Not accepted: self-employment, or employment by a spouse or family member. Approved unpaid leave doesn't break continuity, but doesn't count toward the 6 months.

Income that counts

Base salary, guaranteed allowances (e.g. housing, car, travel paid as cash) and guaranteed non-monetary benefits with a clear cash value in your contract. Excluded: bonuses, commissions, non-guaranteed overtime or penalty rates, reimbursements and superannuation.

Common refusal reasons

Not genuinely working in the nominated occupation; not working from an established business premises; or being paid below the TSMIT/CSIT (or below 90% with an approved concession).

Residency requirements

Where you live (or work) matters

Your residency is assessed against the location in your SkillSelect EOI at the time of invitation.

Visa / pathwayOnshoreOffshore
190Working in NSW in your nominated occupation (20+ hrs/week), or living in NSW continuously for 6 monthsLiving offshore continuously for 6 months
491 Pathway 2 & 3Working in NSW in your nominated occupation, or living in NSW continuously for 3 monthsLiving offshore continuously for 3 months
491 Pathway 1No residency requirement. You must have worked from established business premises in regional NSW for 6 months (20+ hrs/week)
Important: Moving between NSW and offshore resets the residency period. Time spent in NSW on a tourist visa does not count. A short holiday offshore generally won't affect NSW residency if you keep your residence in NSW (assessed case by case).

Proving where you live

  • RequiredBank statements from your main transaction account showing salary and everyday transactions for at least 6 months.
  • Plus any that apply
    • Employment contract and payslips
    • Rental or lease agreement
    • Utility bills (gas, water, electricity)
    • Phone or internet bills
    • Driver's licence or proof of age card
  • All documents must clearly show your name and address.

Invitation rounds

How NSW selects and assesses EOIs

Ranking

EOIs are ranked within each ANZSCO unit group on factors including age, English, education, points score and total years of skilled work. The highest-ranking EOIs are invited, at NSW's sole discretion.

Timing

Rounds run throughout the financial year with no announced dates. The date you submit or update your EOI does not affect your chances. NSW does not accept requests for invitations.

Onshore or offshore

Decided by the usual country of residence, state and postcode in your EOI. Keep these accurate. Your evidence must support the status you were selected under.

14-day invitation

Invitation links are valid for 14 days and are never reissued. Each EOI number can only be invited once. If you miss it, you need a new EOI.

Evidence for every claim

You must substantiate every EOI claim. Documents must be valid at invitation and for at least 5 days after you apply. Meeting only the visa minimum is not enough.

One nomination only

Once NSW nominates you and Home Affairs invites you to apply for the visa, you can't be nominated by NSW again for any skilled visa. A lodged 189 application also makes you ineligible.

Expedited assessment

Possible only if, within 10 working days, your (or your partner's) visa, English test, skills assessment or passport expires, or you'll lose age points and fall below the visa minimum.

Refusals & 491 invites

After a refusal on an invited application (190 or 491 Pathway 2), lodge a new EOI with no waiting period. A 491 invitation can't be switched to 190. Remove 491 from your EOI if you don't want it.

NSW publishes its list at ANZSCO unit group level. Only occupations that are also eligible for the visa are considered. The 491 column shows Home Affairs visa eligibility only: NSW 491 nomination is currently closed, and NSW will publish an updated Regional Skills List. When open, 491 Pathway 1 accepts any 491-eligible occupation. Sources: NSW Skills Lists · Home Affairs skilled occupation list

Designated regional NSW

Regional NSW postcode checker

Subclass 491 holders must live and work in designated regional areas, and Pathways 1 and 3 depend on regional employment or study. Sydney metropolitan postcodes are not regional.

Check a NSW postcode

Category 2 and Category 3 areas both count as designated regional areas for the 491 visa. Category 3 areas also have access to the dedicated regional places, and graduates from regional campuses there can get 2 extra years on a post-study work visa (1 extra year in Category 2).
